The Asylum Seeker Work Permit Extension: An Opportunity Amidst U.S. Worker Shortages

Oct 9, 2023

The recent announcement from the U.S. Citizenship and Immigration Services (USCIS) extending work permits for asylum applicants from two years to five years has grabbed significant attention. This decision, although made to manage the agency’s staggering workload, presents a singular opportunity for businesses, especially amidst the increasing labor shortages that many sectors in the U.S. are experiencing.

The U.S. Worker Shortage

As per recent studies, the U.S. is facing an acute labor shortage across multiple sectors. Many industries, including manufacturing, healthcare, and IT, are finding it challenging to fill roles with qualified personnel. This workforce gap is exacerbating the strain on companies trying to meet their operational demands.

A Surge in Asylum Applications

In the past few years, there has been a significant uptick in asylum claims at the border. USCIS, for instance, has witnessed a 100 percent increase in credible fear cases in 2023 compared to FY 2022. Alongside, President Biden’s policies have made more aliens seek Temporary Protected Status (TPS), further inundating USCIS.

In August 2023 alone, USCIS handled 80,508 decisions on initial work permit applications for asylum seekers. A commendable 91% of these decisions were made within the stipulated 30-day period, and 98% within 60 days. This efficiency mirrors the previous month’s stats, where 89.5% of applications were processed within 30 days. However, 44,840 asylum seekers are still awaiting a decision on their initial work permits, with 6,636 having waited for more than 30 days. This is a slight uptick from the previous month.
